1. 1. Introduction and acceptance
These Terms govern your use of the Takka AI website, platform, and services provided by Takka AI FZE, License No. 4430714, Sharjah, United Arab Emirates. By creating an account, starting a free trial, connecting a third-party channel, or using the service, you agree to these Terms.
2. 2. Eligibility and account responsibility
You must be at least 18 years old and legally authorised to act for the business or organisation you represent. You are responsible for accurate account information, credential security, and all activity within your account and workspace.
3. 3. Description of the service
Takka AI provides tools for managing conversations across WhatsApp, website chat, Instagram, Messenger, and email; creating AI agents; managing knowledge bases; automating orders, appointments, and workflows; human handoff; analytics; billing; and multilingual support. Features may vary by plan, location, and third-party availability.
4. 4. Connected accounts and third-party channels
When connecting Meta, TikTok, WhatsApp, email, or other third-party accounts, you confirm that you have all required permissions and consents. You authorise Takka AI to process data necessary to operate the integration and follow your settings, subject to each third party’s own terms and policies.
5. 5. Customer data and content
You retain ownership of your business content, files, customer conversations, orders, and appointments. You grant Takka AI a limited licence to process this data only as needed to provide, secure, and support the service. You are responsible for required notices and consents from your customers.
6. 6. AI outputs and human oversight
AI outputs may be inaccurate, incomplete, or unsuitable for some situations. You are responsible for configuring agents, reviewing important responses, and maintaining appropriate human oversight, especially for financial, medical, legal, or other sensitive matters.
7. 7. Acceptable use
You may not use the service for unlawful activity, fraud, phishing, spam, privacy or intellectual-property violations, harmful content, security circumvention, unauthorised access, or breaches of Meta, TikTok, or other connected-platform policies.
8. 8. Free trial and subscriptions
Eligible customers may receive a 30-day free trial. After the trial, the paid subscription starts automatically unless cancelled beforehand. Charges are based on the selected plan and usage and may be paid by card, PayPal, or other available methods.
9. 9. Automatic renewal and cancellation
Subscriptions renew automatically for each billing cycle until cancelled. To avoid the next charge, cancellation must be completed before the renewal date. Access normally continues until the end of the current paid period.
10. 10. Third-party charges
Separate charges may apply from WhatsApp, messaging providers, AI-model providers, payment processors, or other third parties. Such charges may be non-refundable once consumed.
11. 11. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted operation. Maintenance, outages, third-party API changes, or events outside our control may affect availability.
12. 12. Intellectual property
All rights in the platform, software, designs, trademarks, and documentation belong to Takka AI or its licensors, excluding customer content. The service may not be copied, resold, or reverse engineered without written permission.
13. 13. Limitation of liability
To the maximum extent permitted by law, Takka AI is not liable for indirect loss, lost profits, lost data, or lost opportunity. Our aggregate liability will not exceed the fees paid to us in the six months before the event giving rise to the claim.
14. 14. Suspension and termination
We may suspend or terminate an account for non-payment, abuse, security risk, unlawful activity, or material breach of these Terms.
15. 15. Governing law
These Terms are governed by the laws of the United Arab Emirates. The courts of Sharjah have jurisdiction unless mandatory law requires otherwise.
